Command Simulator Terms of Use

These Terms of Use govern access to and use of Command Simulator, a Command Presence Consulting training platform. By purchasing, accessing, or using Command Simulator, you agree to these Terms.

If you use Command Simulator for an organization, you represent that you are authorized to accept these Terms for that organization and its authorized users.

Training purpose; not operational or legal advice

Command Simulator provides simulated leadership, personnel, tactical, assessment, and promotional-preparation exercises. It is an educational and training resource. It does not provide legal advice, labor-relations advice, medical advice, personnel action guidance, or incident-command direction.

Users and organizations remain responsible for all real-world decisions and must apply their local department policies, collective bargaining agreements, applicable law, AHJ requirements, operational procedures, and supervisory direction. A scenario score, recommendation, or after-action review is not a directive for a real personnel or tactical decision.

Account access

Access is issued through a passwordless, time-limited sign-in link sent to the purchaser’s or authorized user’s email address. Keep that email account secure. Do not share sign-in links, account access, or purchased organization seats with unauthorized people.

Individual access is for the purchaser’s personal use. Organization access is limited to the purchased number of assigned seats. Command Presence Consulting may suspend or revoke access that is shared, misused, obtained fraudulently, or used in violation of these Terms.

Appropriate use and training contentYou may use Command Simulator for lawful internal training, professional development, and assessment preparation. You may not:

- Copy, resell, sublicense, redistribute, reverse engineer, or publicly display the platform or its content.

- Use the platform to make employment, disciplinary, promotional, or other high-impact decisions about a

person without independent qualified review.

- Upload or enter confidential incident records, protected health information, personnel files, personally identifiable employee information, or other information you are not authorized to share.

- Interfere with the platform, attempt unauthorized access, or bypass seat and account controls.

Intellectual property

Command Simulator, its scenarios, scoring methods, content, interface, trademarks, and other materials are owned by Command Presence Consulting or its licensors and are protected by applicable intellectual- property laws. Except for the limited right to use the platform under these Terms, no rights are granted.

Availability and changes

Command Presence Consulting may update scenarios, scoring, features, policies, and the platform over time. We may temporarily limit access for maintenance, security, or operational reasons. We will make reasonable efforts to keep the service available, but do not guarantee uninterrupted or error-free service.

Disclaimers and limitation of liability

Command Simulator is provided for training purposes. To the fullest extent permitted by law, it is provided “as is” and “as available,” without warranties of any kind. Command Presence Consulting does not guarantee a particular assessment result, job outcome, promotion outcome, operational outcome, or compliance result.

To the fullest extent permitted by law, Command Presence Consulting will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform. Its total liability for a claim related to the platform will not exceed the amount paid for the applicable access during the twelve months before the event giving rise to the claim.

Termination

You may stop using the platform at any time. Command Presence Consulting may suspend or terminate access for a material violation of these Terms, fraud, misuse, or a legal or security need. Sections that by their nature should survive termination will survive.

Changes and contact

We may update these Terms by posting a revised version and revising the effective date. Continued use after the effective date means you accept the updated Terms.

Command Simulator Privacy Policy

This Privacy Policy explains how Command Presence Consulting collects, uses, shares, retains, and protects personal information when you visit, purchase, access, or use Command Simulator.

Information we collect

Depending on how you use the service, we may collect:

- Contact and account information, including name and email address.

- Purchase and access information, including product purchased, purchase status, order reference, account entitlement, organization membership, and seat assignment.

- Training information, including scenario selections, responses, scores, completion history, after-action review data, and saved progress.

- Support communications you send to us.

- Limited technical information needed to operate and secure the service, such as browser/session data, IP-derived security signals, logs, and timestamps.

Do not enter real personnel files, health information, confidential incident material, or sensitive personal information into scenarios or response fields.

How we use information

We use information to process purchases and activate access; send passwordless sign-in links and service messages; provide, maintain, secure, and improve Command Simulator; preserve user progress; provide organization reporting to authorized organization administrators; respond to support requests; enforce our

Terms; and comply with legal obligations.

How we share information

We share information only as needed to operate the service, including with service providers that support commerce, email delivery, hosting, security, and infrastructure. These include Squarespace for commerce and order processing and Resend for access-email delivery.

If an account is assigned to an organization, authorized organization administrators may see organization-level participation and training reporting for the members they administer. We do not sell personal information.

We may disclose information when required by law or when reasonably necessary to protect rights, safety, security, or to investigate fraud or misuse.

Retention and security

We retain account, purchase, training, and support information for as long as reasonably necessary to provide the service, meet legal and accounting requirements, resolve disputes, enforce agreements, and maintain security. We may retain de-identified or aggregated information longer.

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No online system is completely secure. Protect access to the email account used for your passwordless sign-in link.

Your choices and requests

You may request access, correction, or deletion of your personal information by emailing CommandPresenceCo@gmail.com. We may need to verify your identity and may retain certain information when required or permitted by law.

Marketing communications, if offered, will include an unsubscribe method. Transactional messages, including purchase receipts and sign-in links, may still be sent when needed to provide the service.

ChildrenCommand Simulator is intended for professional fire-service training and is not directed to children. Do not use the service if you are under 18.

Command Simulator Refund & Access Policy

Command Simulator is a digital training service. Access is activated after purchase through a secure email sign-in link.

Refunds

First-time individual purchasers may request a refund within 14 calendar days of purchase if they have completed no more than one scenario.

To request a refund, email CommandPresenceCo@gmail.com with the purchaser name, purchasing email address, and order information.

Refund requests are reviewed within five business days. Approved refunds are returned to the original payment method when possible. Processing time after approval depends on the payment provider and financial institution.

The following are generally not eligible for refunds unless required by law or approved by Command Presence Consulting:

- Purchases made more than 14 calendar days earlier.

- Accounts that have exceeded the stated training-use limit for a refund.

- Organization, department, bulk-seat, or custom purchases, which are governed by their purchase agreement or written proposal.

- Access suspended for fraud, unauthorized sharing, or violation of the Terms of Use.

A refund ends the applicable access entitlement. If access was purchased for an organization, Command Presence Consulting may deactivate the associated organization access after an approved refund.

Access issues

If you cannot access Command Simulator because a sign-in link was not received or a technical issue prevented reasonable use, contact support before submitting a refund request. We will attempt to restore access first.

Need a new sign-in link?

Visit [Command Simulator] (https://simulator.commandpresenceconsulting.com), enter the email address used for purchase or assigned by your organization, and select “Send secure sign-in link”.

The link expires after 15 minutes and can be used once.

If you do not see the email.

Check your Inbox, Spam, Junk, and Promotions folders. Department email systems may also place the message in a quarantine or filter.

For your security, do not send passwords, payment-card information, magic-link URLs, or confidential personnel information to support.
